Victory: Missouri AG Intervenes to Drop Charges Against St. Louis Couple Who Fended off Mob With AR-15

In June, St. Louis couple Mark and Patricia McCloskey defended their home when a roving band of leftist rioters broke down the gate to their home and ventured onto their property. Both are lawyers. They defended themselves with their legally acquired firearms. Of course, this set off a firestorm among liberal media types. It’s as if they just ignored the weeks of riots, arson, looting, and violence against police in the aftermath of George Floyd’s death in Minneapolis in May.

The police have been unable to truly bring order to the situation. The McCloskey response was not illegal. It was not out of control. It was right. And yet, they faced the legal wrath of God from St. Louis Prosecutor Kim Gardner who charged them with brandishing. Their weapons were seized by police. Well, now Missouri’s Attorney General Eric Schmitt is stepping to stop what pretty much is a politically motivated legal action against the McCloskeys.

Before the attorney general’s intervention, the McCloskey’s attorney, Joel Schwartz, filed a motion to disqualify Gardner from pressing charges, citing remarks on her campaign literature (via CBS KMOV4 ):

In a court filing, Joel Schwartz claims Circuit Attorney Kim Gardner should not be allowed to prosecute their case because of statements made by her campaign regarding the incident. The McCloskeys were charged by Gardner's office after they were seen pointing guns outside their home in the Central West End last month.

According to Wednesday's court filing, in one email, sent out before charges were filed, Gardner's campaign literature read: "You might be familiar with the story of the couple who brandished guns during a peaceful protest outside of their mansion” and “...President Trump and the Governor are fighting for the two who pointed guns at peaceful citizens...” The literature contained links to donate to her re-election campaign.

The filing also states campaign literature was sent after the charges, again referencing the McCloskeys' case and links to donate.

Gardner and attorney Mary Pat Carl are facing off in the Democratic primary Tuesday. The winner is the presumptive circuit attorney for the next four years.

Alas, justice has prevailed. Disturbingly, the same could not be said for former National Security Adviser Michael Flynn, who remains in legal purgatory, as the DC Court of Appeals will...

  1. Full justice will not occur until Gardner is sanctioned, fined, prosecuted, disbarred, or otherwise punished for her abysmal official behavior. Problems aren't solved just because repairs are made. Something needs to be done to prevent it from ever happening again.

  2. I'll believe that this couple have nothing to fear from the law when they get their weapons back from the police, who illegally confiscated them. In fact, if the AG's order does NOT contain language ordering the return of the weapons, they're still in jeopardy from that rogue local AG, IMHO.

  3. Seems it took an act of journalism by 'law enforcement today' and 'citizens free press' to get the Missouri AG to act.
Eric Schmidt shoulnt have to stand over local prosecutors reversing blantant prosecutoral
    Injustice.

  4. "The voters of St. Louis own this mess." Indeed, and the McCloskey's are two leftist lawyers who are among them. Like all other commies they "thought" they were exempt from the tyranny they put on others. I hope it cost them a million in legal fees and a good lesson in voting responsibility. Any bets they'll vote Biden in November? Beuller? Beuller?

  5. Ten to one the state AG was given a choice he couldn't refuse. Nobody, not even the president, have half as much power as some think... unless they do an obvious grab. But if ten certain people call, even the deaf hear. Just how far that goes is anyone's guess. Being lefties, I wouldn't mind seeing their mansion go up in smoke with them in it. If South Africa has come to America, let it start with the political plantation owners.

    1. Right? But the problem is, the left wins either way. Either they get a judge to drop it, or a bunch of them. Or, they get the state to pay off their malfeasance. The state get's bankrupted or civil rights (the real ones) become further abridged. For modern anarchists, both categories are wins. Even if the DA gets dropped hard, she will merely be replaced by same or worse. This isn't going to be solved by courts or elections at this point. Stock up on beans, guns and ammo, medical, and a few other things.
