Or in this case, no decision at all...
ReplyDeleteUgly. Never trust, or argue with, anything that outweighs you 10 to 1. The fact that the driver ran through a red light is no consolation for being dead.
ReplyDeleteI must agree. I see dozens of people each week here in CA who willfully jay walk down a poorly visible stretch of road with nearby crosswalks or cross against the light in a marked crosswalk. Sure, they do it because CA has made it clear that the "driver is always at fault" and must always yield to a pedestrian. They apparently don't realize that they can't always be seen (as they can be blocked by a vehicle in the other lane, by landscaping, by glare, etc.) or that drivers may not be paying attention. Being "in the right" is hardly a consolation when you are dead.
ReplyDeleteI assume that the pedestrian in this case didn't survive given the horrific nature of the impact. In this case, the driver is 100% at fault, and many pedestrians can learn to pay attention when crossing the street-even in a legally marked crosswalk with the right of way.
