Sheriff is wrong - they don't have to 'cock it.' Firearms 101 obvious stuff: it may be a) already cocked ala 1911, b) striker fired ala all the plastic pistols, or c) double action pistol or revolver? Someone has been watching too many movies where they rack the slide just in time to save the day.
In Florida, he does not need to point it at you nor does it need to be a gun. You can center fire the criminal under a life threatening situation and eliminate the threat. That is one excuse I love here.
