Unfortunately, Trump cannot pardon Penny because he isn't up on Federal charges. The President cannot pardon NY State convictions only Federal convictions.

In any event, I will confidently predict that Daniel Penny will need no pardon. Even a pathetic excuse for a jury that usually sits in Manhattan is unlikely to convict Daniel Penny with the evidence produced by POS Alvin Bragg's office. If it does convict him, this will serve as just one more reason for sane people to flee the State of New York.
Fleeing is giving up. Why cede the land to the wicked. Why acquiesce to their twisted misuse of the law. Yes, it is difficult to win back, but not fighting assures defeat.
