After Shooting Ashli Babbitt, Capitol Police Lt. Made False Radio Report


Previously undisclosed radio dispatch, obtained exclusively by The Epoch Times, reveals Lt. Byrd’s actions after fatally striking Ms. Babbitt.

Within a minute after firing the fatal bullet that struck Ashli Babbitt on Jan. 6, 2021, U.S. Capitol Police Lt. Michael Byrd broadcast a radio report claiming shots were being fired at him in the Speaker’s Lobby and he was “prepared to fire back,” a federal lawsuit alleges.

The previously undisclosed radio dispatch is also contained on an audio recording obtained exclusively by The Epoch Times of the “OPS2” dispatch channel used by Capitol Police on Jan. 6.
Information on the recording is contained in a federal lawsuit filed on Jan. 5 by Ms. Babbitt’s widower, Aaron Babbitt of San Diego. Mr. Babbitt, backed in his lawsuit by Judicial Watch, is seeking $30 million from the U. S. government for wrongful death.

According to the lawsuit, Mr. Byrd fired his Glock 22 .40-caliber pistol, striking Ms. Babbitt in the left shoulder, then announced that he was being fired upon and was ready to return fire.

“In fact, no shots were fired at Lt. Byrd or his fellow officers,” the lawsuit stated. “The only shot fired was the single shot Lt. Byrd fired at Ashli. He heard the loud noise of the gunshot. He saw her fall backward from the window frame.”

The Epoch Times reached out to Capitol Police and Mr. Byrd’s attorney for comment on the lawsuit and its allegations. Mr. Byrd is now a captain with U.S. Capitol Police.

A few minutes prior to the shooting, a police dispatcher mistakenly reported, “They’re taking shots into the House floor.”

“Lt. Byrd erroneously believed and acted on a false radio call and/or false report of shots fired on the House floor occurring before he left the House floor and moved across the Speaker’s Lobby to the adjacent Retiring Room,” the suit said.

“A reasonably prudent officer in Lt. Byrd’s position would have been aware that, in fact, the report was false and the sound heard on the House floor was glass breaking, not shots fired,” the lawsuit alleged.

It is not clear why Mr. Byrd made the statement that he was taking fire and was prepared to fire back. His radio dispatch occurred up to a minute after he fired on Ms. Babbitt, the suit said.

“The facts speak truth. Ashli was ambushed when she was shot by Lt. Byrd,” the lawsuit said. “Multiple witnesses at the scene yelled, ‘You just murdered her.’”

“Lt. Byrd was never charged or otherwise punished or disciplined for Ashli’s homicide,” the suit stated.

In his only public statements about the shooting—made not to investigators but to an NBC television anchor—Mr. Byrd never mentioned his radio dispatch or his claim that shots were being fired at him and other officers. Nor did he use that as justification for firing his weapon and killing Ms. Babbitt.

An unknown U.S. Capitol Police officer first reported shots fired in the U.S. House just before 2:43 p.m., followed later by Mr. Byrd’s shots-fired announcement, according to the audio recording obtained by The Epoch Times. Both reports turned out to be unfounded.

Officer: “Shots fired, House floor. Shots fired, House floor. Immediate assistance.”
Dispatch: “Shots fired, House floor. Shots fired, House floor.”
2nd Dispatcher: “I need units to re…,” which was cut off mid-sentence. That message ceased on the OPS2 channel but was heard in full on the OPS1 channel:

“I need units to respond to the chamber, the House chamber floor,” the dispatcher said. “Again, units need to respond to the House floor in reference to shots fired. They were shots fired at the House floor. Again, units to respond. They’re taking shots into the House floor. We need units to respond to that location. 1443 hours.”
Lt. Byrd: “405-B. We got shots fired in the lobby. We got fot (sic), shots fired in the lobby of the House chamber. Shots are being fired at us, and we’re prepared to fire back at them. We have guns drawn. [Unintelligible] Don’t leave that end! Don’t leave that end!”

Mr. Byrd’s dispatch was followed by 11 seconds of radio silence.

The transcript of the OPS2 radio communications provided by the Department of Justice (DOJ) as evidence in Jan. 6 criminal cases does not include the words “we’re prepared to fire back at them.” The DOJ transcript instead says, “and it went, so we locked it down.”
Dispatcher: “Simulcasting, shots fired on the House floor again.”
Lt. Byrd: “We’ve got an injured person. I believe that person was shot. It was…” (cut off by another transmission).
Unknown officer: “…Shot, one down, civilian. We need EMTs. We need… Come through on the west side of the building … to the House lobby.”
Dispatch: “That’d be House…”
Lt. Byrd: “405-B, did you copy?”
Dispatch: “I copied. House lobby, west side. Individual…”

Mr. Byrd retreated from the entrance to the seated area in the Speaker’s Lobby. Officer Mike Brown, a member of the USCP Containment and Emergency Response Team (CERT), said Mr. Byrd was “down and out and almost in tears.”

20 (Or So) Obvious Questions About January 6

Even before Donald Trump ascends to the presidency on January 20, his appointees should ask themselves the questions that follow — all of them simple and straightforward. With Christopher Wray stepping down from the FBI directorship, they will have a much better chance of getting straight answers quickly.

Trump’s team should then share those answers widely. This information will make President Trump’s pardon of more than 1,500 Americans much more comprehensible to the American public and much less controversial.

–Although now the FBI admits to having 26 confidential human sources in the crowd on January 6, how many total “assets” did the FBI and other entities plant, and what roles did they play?

Was Ray Epps working for an entity? And if so, under what terms?

–Who planted the pipe bombs outside the DNC and near the RNC headquarters?

–Who instructed Kamala Harris to conceal the fact that she was at the DNC when the bomb was found and why?

–Why did Harris allow hundreds of J6ers to be prosecuted for threatening her designated space at the Capitol when she wasn’t at the Capitol?

–Who were the “two law enforcement officials” who told the New York Times that “pro-Trump rioters” fatally struck Capitol Police officer Brian Sicknick with a fire extinguisher, inflicting “a bloody gash in his head”?

–Who orchestrated the 100-day-plus suppression of Sicknick’s autopsy report?

–If Sicknick was not murdered, as the DOJ finally conceded, why did a federal judge give Julian Khater an 80-month prison sentence for spritzing Sicknick with an over-the-counter pepper spray?

–Has there been an official inquiry into the subsequent suicide deaths of four USCP officers, and if not, why has the DOJ routinely blamed the J6ers for causing those deaths?

–Why was there no crime scene investigation in the likely homicide of Rosanne Boyland?

–Who chose to ignore the obvious video evidence of Boyland being suffocated as a result of a police action and to falsely blame her death on an amphetamine overdose?

–Who suppressed the Boyland autopsy report for 90 days and stonewalled her family at every turn?

–Why was Lila Morris, the Metropolitan P.D. officer caught on video repeatedly bashing the unconscious Boyland over the head with a tree branch, not even disciplined?

–Why was Metropolitan P.D. lieutenant Jason Bagshaw promoted despite having been caught on video bashing the defenseless Victoria White bloody?

–Why did the DOJ not interview the eyewitnesses to the shooting death of Ashli Babbitt?

–Why did the USCP coddle and promote Babbitt’s killer, Michael Byrd, despite a shooting that, according to use-of-force expert Stan Kephart, “violated not only the law but his oath”?

–Who ordered the “shock and awe” raids on the homes of hundreds of non-violent protesters and why?

–Why has the so-called “Scaffold Commander” not been arrested despite multiple clear images of his face?

–Why has the man who constructed the mock gallows on the Capitol grounds not been arrested despite multiple clear images of his face?

–Why did the USCP allow the gallows to stand unmolested on Capitol grounds for more than four hours before the crowds gathered?

–Why was Emanuel Jackson quickly set free despite having been caught on video swinging a baseball bat at police officers over a two-hour period?

–If there was no insurrection, as the DOJ conceded, why were the sentences given to the J6ers so much more severe than the $30–50 fines given to the protesters who physically obstructed the Kavanaugh hearings?

These are the simple questions, the ones off the top. I am sure readers will think of others I may have overlooked. To be sure, more probing questions need to be asked about the January 6 Select Committee report as well as the charging documents for the J6ers.
Having read through much of this material, I am impressed by how casually — and routinely — our elected officials and federal jurists distort the facts to protect the party line. In short, they lie, and some have done so under oath.

I am impressed, too, by the shamelessness of a DOJ that can boast of its success rate in securing convictions, knowing that the accused were allowed no change of venue and faced juries pulled from a pool 95 percent anti-Trump. This needs to change.

More questions need to be asked as well about the security failures at all levels on January 6. In his otherwise worthy book, Government Gangsters, Kash Patel more or less exonerates the Pentagon. He should not have. Incompetence explains much of what went wrong on January 6, but so does treason.

Nearly 1,600 American citizens were arrested for exercising their First Amendment rights on January 6, and roughly half of them have been incarcerated. Save for the insurrectionists among them — if there were any — the rest deserve not just commutation of their sentences, but a full pardon. Many may deserve compensation. And all deserve the truth.

IRS Can Enter ‘Anyone’s House at Any Time’: Abuse Detailed in New Weaponization Report

An IRS agent showed up at the door of a Marion County, Ohio, woman and lied about his reason for being there.

Once inside, the Internal Revnue Service agent, purporting to be named Bill Haus, began to harass and intimidate the taxpayer, according to a congressional report released Friday.

The woman called a lawyer, who told the IRS agent to leave the home since the taxpayer had gotten no prior notice of unpaid taxes.

“I am an IRS agent. I can be at and go into anyone’s house at any time I want to be,” responded the agent, who was using a phony name, according to the report from the House Judiciary Select Subcommittee on the Weaponization of the Federal Government.

Under pressure from Congress, the IRS discontinued its policy of unannounced home visits in July.

The select subcommittee’s 22-page report is titled “Fighting the Weaponization of the Internal Revenue Service (IRS): The End of Abusive Unannounced Field Visits.”

The Ohio woman’s experience is one of several examples of IRS abuse included in the House panel’s report.

“After the taxpayer called the police, the revenue officer even filed a complaint against the police department,” the report says. “The IRS later confirmed that the taxpayer owed nothing and acknowledged the situation ‘never should have gotten this far.’”

Under Democrat control, Congress voted in August 2022 to boost IRS funding by $80 billion over 10 years. The funding increase prompted congressional Republicans to demand more oversight of the agency.

“This shocking abuse of power is a startling indication that the IRS believes it may do what it wants, when it wants,” the report says.

House Judiciary Chairman Jim Jordan, R-Ohio, also is chairman of the weaponization subcommittee.

The report from the subcommittee also details an IRS field visit to the home of journalist Matt Taibbi on the same day he testified to Congress about government censorship.

The IRS initiated a case against Taibbi on Christmas Eve, three weeks after the reporter published the first installment of the “Twitter Files.”

The “Twitter Files” was a series of reports based on new owner Elon Musk’s release of information to Taibbi and several other journalists about the social media site’s practices, including its relationship with the federal government. (Musk later changed Twitter’s name to X.)

“In the four-and-one-half years between when the IRS alleges it last tried to contact Mr. Taibbi and the day it conducted an unannounced field visit, neither he nor his accountant ever received notice from the IRS about an issue with his tax return,” the report says.

“The IRS conducted its field visit even though Mr. Taibbi did not owe the IRS anything; rather, the IRS owed Mr. Taibbi a substantial refund,” the report continues. “The unannounced field visit alarmed Mr. Taibbi, who viewed it as an attempt to chill his reporting about government abuses.”

Are Mitch McConnell and His Wife Financially Tied to Communist China?

Following the money has always been the surest way to finding where a politician’s true loyalties lie.

Peter Schweizer, a senior contributor for Breitbart and author of such exposés as Clinton Cash and Profiles in Corruption, said on Fox News’ The Next Revolution that McConnell’s “position on China has softened over the years,” a change Schweizer attributed to the growing relationship between the Chinese government and the Chao family’s company.

“Really, it goes to the fact that Mitch McConnell and Elaine Chao, his wife, are financially tied to the Chinese government,” Schweizer explained. “And it comes through the shipbuilding company that Elaine Chao’s family owns. That relationship was forged in December of 1993 when James Chao, Elaine Chao’s father, Elaine Chao, and the new son-in-law, Senator Mitch McConnell, visited Beijing, China, at the invitation of the China state shipbuilding corporation.”

“This was a coup to Beijing because Tiananmen square had happened just four years earlier. Very few high officials went there,” the author continued. “The result of that meeting and the deals that followed is that today the Chinese government finances the construction of the ships for the shipbuilding company, they build the ships, they provide the crews for the ship, and they provide the cargo for the ship.”

He went on to explain that Beijing could immediately end its dealings with the shipbuilding corporation if it wanted to, which would be bad for McConnell. The Chinese government, according to Schweizer, only does business with this corporation because of McConnell’s role as a powerful U.S. Senator.

“So, the Chinese government could pull the plug tomorrow on this business. And the reason they’re doing business with them, let’s make it clear, is because Mitch McConnell is a very powerful figure in Washington, D.C. And the problem is … that his position on China has softened over the years the closer that this commercial relationship has become, and he’s a direct beneficiary of what this business does.”

Per Schweizer, this is the “strategy” communist China uses around the world. “They seek out political elites and give them commercial deals,” he said, adding that the McConnells are “wedded to the Chinese. They don’t want to anger the Chinese because they could destroy their families financially.”

McConnell will remain Majority Leader until noon on January 20, with the inauguration of Joe Biden. Kamala Harris’ ascendance to the vice presidency will give Democrats (due to the vice president’s role as president of the Senate with tie-breaking ability) the voting majority they need to assume control of the chamber.

As The New American has previously reported, McConnell is apparently pleased with the impeachment of President Trump, seeing it as a way to purge the party of him.

Nevertheless, in the battle for the hearts of Republican voters, Donald Trump remains the unquestioned victor. Polling shows that a solid majority of the base still supports the president’s recent behavior and would like him to be the 2024 presidential candidate.

It should be noted that McConnell’s wife, Elaine Chao, was until recently President Trump’s secretary of transportation. She resigned from the post in response to the Capitol breach on January 6.

“Yesterday our country experienced a traumatic and entirely avoidable event as supporters of the President stormed the Capitol following a rally he addressed,” wrote Chao in a letter to colleagues in the Department of Transportation. “As I’m sure is the case with many of you, it has deeply troubled me in a way that I simply cannot set aside.”

McConnell has shown himself to be, if anything, an astute and cunning politician who knows how to stay at the center of Washington politics and use the influence of his office for his own financial benefit, constantly winning over the...

Kamala Harris Backs Publicly Funded Health Care for Illegal Immigrants

















In May of 2019, Kamala Harris unequivocally told CNN’s Jake Tapper that she would make no distinction between American citizens and illegal immigrants on a broad array of measures. When Tapper referred to benefits for “people who are in this country illegally,” Harris replied: “Let me just be very clear about this. I am opposed to any policy that would deny in our country any human being from access to public safety, public education or public health, period.” Joe Biden’s position on the same matter has been murky: Like all of the other Democrats on stage he raised his hand when Savannah Guthrie asked, “Raise your hand if your government plan would provide coverage for undocumented immigrants.” His campaign later claimed that Biden meant only that undocumented immigrants could purchase health insurance via Obamacare. But Biden was specifically asked about Medicare and Medicaid last June, and he said, “Look, I think that anyone who is in a situation where they are in need of health care, regardless of whether they are documented or undocumented, we have an obligation to see that they are cared for.”


Free Healthcare Would Draw Illegals Like Magnet To Steel:


Harris’s campaign got off to a terrible start last January when she blithely said, also on CNN, that she would eliminate private health insurance, though she later walked back that position.

“The idea is that everyone gets access to medical care and you don’t have to go through the process of going through an insurance company, having them give you approval, going through all the paperwork, all of the delay that may require,” Harris initially said. “Who of all us have not had that situation where you have to wait for approval and the doctor says, ‘I don’t know if your insurance company is going to cover this.’ Let’s eliminate all of that. Let’s move on.” She later clarified that by saying she was talking about eliminating bureaucracy and waste, not private health insurance, but as late as June 27 of last year, she was one of only two candidates at a Democratic debate who raised their hands when asked whether anyone would eliminate private health insurance. The next day she claimed she had misunderstood the question, which was “Many people watching at home have health insurance through their employer. Who here would abolish their health insurance in favor of a government-run plan?” Only Harris and Bernie Sanders raised their hands.

The Democratic Party position is usually slightly more nuanced: It involves not eliminating private health insurance directly but putting it out of business indirectly, so as to maintain plausible deniability with the aid of the media. First step: Set up a public option, or “Biden plan.” This would, of course, wipe out all private health insurers, as Joe Biden frankly admitted in his New York Times editorial board interview, because no private company would be able to compete with...

SINCE RETIRING FROM the military last year, former Chair of the Joint Chiefs of Staff Army Gen. AG Merrick Garland Calls Voter ID Laws ‘Unnecessary’







Attorney General Merrick Garland on Sunday said his agency is “fighting back.”

Attorney General Merrick Garland on March 3 declared that efforts by states to implement voter ID laws are “unnecessary” and “burdensome,” drawing the ire of Republicans.

While speaking at a church Selma, Alabama, the attorney general was commemorating the 59th anniversary of the targeting of demonstrators by Selma police during an early civil rights protest.

He said that the right to vote “is still under attack,” though he provided little evidence in his speech for how requiring identification would be an assault on voting rights.

“There are many things that are open to debate in America,” Mr. Garland stated. “One thing that must not be open for debate is the right of all eligible citizens to vote and to have their vote counted.”

The attorney general said the Department of Justice is “fighting back” against states that have passed bills requiring identification that would prove such eligibility to cast ballots.
“One of the first things I did when I came into office was to double the size of the voting section of the civil rights division,” Mr. Garland said. “That is why we are challenging efforts by states and jurisdictions to implement discriminatory, burdensome, and unnecessary restrictions on access to the ballot, including those related to mail-in voting, the use of drop boxes, and voter ID requirements.”

“Those measures include practices and procedures that make voting more difficult; redistricting maps that disadvantage minorities; and changes in voting administration that diminish the authority of locally elected or nonpartisan election administrators,” he said. “Such measures threaten the foundation of our system of government.”

The attorney general also accused courts of issuing rulings that, according to him, imperil U.S. voting rights.

SCOTUS Unanimously Rules States Cannot Disqualify Trump from 2024 Ballot







WASHINGTON, DC – Colorado cannot disqualify former President Donald Trump from appearing on the 2024 ballot, the U.S. Supreme Court ruled unanimously Monday.

In a historic ruling, the Supreme Court said only Congress can disqualify a candidate from the ballot using the Fourteenth Amendment’s “Insurrection Clause,” overturning a 4-3 opinion in December from the Colorado Supreme Court that the provision prohibits former President Donald Trump from appearing on the ballot for the presidency in 2024.

That ruling partially reversed a prior ruling in November that Trump is not an officer of the United States as defined by the Fourteenth Amendment and that the Amendment therefore cannot be used to disqualify him from appearing on the Colorado primary ballot.

This is the first time the U.S. Supreme Court has ruled on Section 3 of the Fourteenth Amendment.
The court wrote:
Proposed by Congress in 1866 and ratified by the States in 1868, the Fourteenth Amendment expanded federal power at the expense of state autonomy and thus fundamentally altered the balance of state and federal power struck by the Constitution. […]
The court continued:

Section 3 works by imposing on certain individuals a preventive and severe penalty—disqualification from holding a wide array of offices—rather than by granting rights to all. It is therefore necessary, as Chief Justice Chase concluded and the Colorado Supreme Court itself recognized, to ‘ascertain what particular individuals are embraced’ by the provision. […]

Chase went on to explain that to accomplish this ascertainment and ensure effective results, proceedings, evidence, decisions, and enforcements of decisions, more or less formal, are indispensable. […]

The Constitution empowers Congress to prescribe how those determinations should be made. The relevant provision is Section 5, which enables Congress, subject of course to judicial review, to pass “appropriate legislation” to “enforce” the Fourteenth Amendment. […]
The court went on to note that Congress did so by passing the Enforcement Act of 1870.
This case raises the question whether the States, in addition to Congress, may also enforce Section 3. We conclude that States may disqualify persons holding or attempting to hold state office. But States have no power under the Constitution to enforce Section 3 with respect to federal offices, especially the Presidency. […]

Granting the States that authority would invert the Fourteenth Amendment’s rebalancing of federal and state power. […]

Nor have the respondents identified any tradition of state enforcement of Section 3 against federal officeholders or candidates in the years following ratification of the Fourteenth Amendment. The Left Demands Millions of Human Sacrifices to Appease the Gods of Climate Change












“At their Monday night poker game in hell,” writes Mark Steyn, “I’ll bet Stalin, Hitler, and Mao are kicking themselves. ‘It’s about leaving a better planet for our children?’ Why didn’t we think of that?”

These three evil socialists of yesteryear would certainly be green with envy at the way today’s green socialists have convinced millions of citizens to willingly surrender their liberty to the State.

On the other hand, high priestesses like Nancy Pelosi assure the faithful that hurricanes on the Gulf Coast and wildfires on the West Coast are signs that “Mother Earth is angry,” and is visiting her vengeance upon us.

Quite literally, today’s party of The Science™ is an apocalyptic doomsday cult which fears the wrath of deities that are personified by nature, complete with the sacrifice of countless children.

Does President Trump have that missing CIA binder that the Deep State is sooooo desperate to find? New info emerges…












Where’s the binder? That’s the burning question echoing through the swampy marshes of DC, and it’s been hanging in the air for some time. Rumor has it, this binder is packed with the real story behind the Russia Hoax—a narrative that deviates sharply from the widely reported “tip” originating from our Australian pals. A binder containing highly classified information related to Russian election interference went missing at the end of Donald Trump’s presidency, raising alarms among intelligence officials that some of the most closely guarded national security secrets from the US and its allies could be exposed, sources familiar with the matter told CNN.

Its disappearance, which has not been previously reported, was so concerning that intelligence officials briefed Senate Intelligence Committee leaders last year about the missing materials and the government’s efforts to retrieve them, the sources said.

In the two-plus years since Trump left office, the missing intelligence does not appear to have been found.

The binder contained raw intelligence the US and its NATO allies collected on Russians and Russian agents, including sources and methods that informed the US government’s assessment that Russian President Vladimir Putin sought to help Trump win the 2016 election, sources tell CNN.

The intelligence was so sensitive that lawmakers and congressional aides with top secret security clearances were able to review the material only at CIA headquarters in Langley, Virginia, where their work scrutinizing it was itself kept in a locked safe.

That binder is thought by many to be in President Trump’s possession, and that’s the real reason the FBI raided Mar-a-Lago.
