The Hong Kong protesters are fighting for liberty, but major U.S. firms with business ties to China are siding with the authoritarian state. That’s not okay.

In the middle of the night on Sunday, pro-democracy protesters hauled a ten-foot statue known as “Lady Liberty” to a mountaintop overlooking Hong Kong as protesters clashed with riot police in the city below. The statue depicts an injured young woman in goggles and a helmet, holding an umbrella in one hand and a black flag in the other and proclaiming the protesters’ rallying cry, “Liberate Hong Kong, revolution of our times.”

The Hong Kong protesters are fighting for liberty, but they’re also fighting for their lives as Beijing tightens its grip on the city. Videos of riot police chasing and beating protesters in the streets—including one viral video of a “de-arrest” featuring a protester’s flying high-kick on a police officer—circulated Sunday on Twitter.

The high-kick video was shared via WhatsApp, a messaging platform owned by Facebook, one of the few U.S.-based companies willing to stand up to the Chinese government as tensions rise in Hong Kong. Last month, the social media giant shut down an attempt by Chinese officials to use “hotlines” on WhatsApp to track and monitor Hong Kong protesters.

Police had planned to use the hotlines to let members of the public post photos and videos of protest activity, allowing police to gather intelligence on the protesters. The movie Titanic had one really good scene. The ship had already swiped the iceberg. The behemoth continued sailing along and appeared to be doing just fine. But one person on the ship, Thomas Andrews, knew that it was doomed. Andrews was a naval architect who was in charge of the plans to build the ship.

After he tells the captain and some other key people on the ship that it is going to sink, they react in disbelief. One declares that the ship can't possibly sink.

Andrews responds, "She's made of iron, sir! I assure you she can. And she will. It is a mathematical certainty."

It's one of cinema's great scenes as men wrestle with approaching doom, made all the stronger by Victor Garber's superb performance. It's also the perfect metaphor for our current moment in history.

People pay too little attention to math because numbers lie far less effectively than words. There comes a point when a nation has raced over the cliff, but it may take years before that reality becomes obvious to everyone.

This movie scene was on my mind heading into election night in 2016. All indications were that Hillary Clinton was going to be elected. Based upon the math, America as a nation appeared doomed. Clinton was eyeing the White House like a ravenous wolf and relishing the opportunity to cast misery across America.

But Wisconsin and then Michigan and finally Pennsylvania vomited on her pantsuit. On election night, I had no idea what we had just elected, but the fact that it wasn't Clinton was more than enough for one night.

Three years later, President Trump has shattered conservative expectations and may go down in history as one of the greatest U.S. presidents. It brings to mind another historical surprise. Winston Churchill was elevated to leadership during England's darkest days against all odds. He was under withering attack by both the opposing party and his own in those early months, and his survival as leader was very much in doubt.

Trump was also elevated under extraordinary circumstances that many would regard as a historical anomaly. As a New York real estate mogul and non-politician, he was declared unelectable by prominent and respected Republican pundits. Recently declassified court documents confirmed all of our worst suspicions about NSA spying.

Many people view NSA spying as relatively harmless. They argue it doesn’t violate the Fourth Amendment because the agency doesn’t even look at most of the information it collects.

This is a fallacious argument. Virtually nobody would sit by and let federal agents come into their home, make photocopies of all their personal papers and then store them away with the promise of “we won’t look at them without a warrant.” Sweeping up and storing electronic data is no different.

Even if you buy these silly legal gymnastics, by storing phone calls, emails, location information, and web searches belonging to millions of Americans, the NSA facilitates unconstitutional, warrantless surveillance.

And a 138-page ruling by U.S. District Court Judge James E. Boasberg confirmed just that. It revealed that the FBI regularly accessed millions of Americans’ data that was unconstitutionally gathered and stored by the federal spy agency. The government is accessing this information. It is not obtaining warrants. And this does violate the Fourth Amendment.

ACLU staff attorney Patrick Toomey told The Intercept that the FBI used the information for “fishing expeditions.”
“These opinions reveal devastating problems with the FBI’s backdoor searches, which often resembled fishing expeditions through Americans’ personal emails and online messages. But the court did not go nearly far enough to fix those abuses. The Constitution requires FBI agents to get a warrant before they go combing through our sensitive communications.”
Documents leaked by Edward Snowden revealed the existence of warrantless dragnet surveillance programs run by the NSA. The court ruling centered around spying “authorized” under Sec. 702 of the Foreign Service Intelligence Act (FISA). Under this provision, the government can collect data on Americans who are communicating with non-U.S. citizens without a warrant.

As Andrew Napolitano explained, “the FISA-created process permits a secret court in Washington to issue general warrants based on the government’s need to gather intelligence about national security from foreigners among us. It pretends that the standard is probable cause of foreign agency, but this has now morphed into the issuance of general warrants whenever the government wants them.”

A typical FISA warrant authorizes government surveillance on all landlines, mobile devices and desktop computers in a given area. While the process was created to monitor foreign agents, it sweeps up reams of data belonging to...
