‘Egregious abuse of power’: Michael Flynn cites FISA report in motion to dismiss case against him

The legal team for retired Lt. Gen. Michael Flynn cited the Justice Department watchdog’s bombshell report on Foreign Intelligence Surveillance Act abuse as the former Trump national security adviser seeks to have the government’s case against him dismissed.

“Even though the investigation pertains to the abuses of the FISA process, not the FBI and DOJ’s misconduct regarding Mr. Flynn, the IG report simultaneously documents at least some of FISA process abuses and misconduct against Mr. Flynn,” lead defense counsel Sidney Powell told a federal court last week. “The IG report is replete with exculpatory evidence that, had it been known to Mr. Flynn, he never would have pled guilty.”

Flynn, 61, pleaded guilty in December 2017 for lying to investigators about his conversations with then-Russian Ambassador to the U.S. Sergey Kislyak, but last week he told the U.S. District Court in Washington, D.C., that “in truth, I never lied” and “I am innocent of this crime." Powell, a former federal prosecutor, took over representing Flynn last summer.

Powell said “the case against Mr. Flynn should be dismissed immediately for this egregious abuse of power and trust” laid out in Inspector General Michael Horowitz’s report.

Powell pointed to a revelation that showed the intelligence briefing the FBI gave to Trump’s team in August 2016 during the presidential campaign was actually a “pretext” to gather evidence to help in the counterintelligence investigation into Trump’s campaign. The FBI agent who led that briefing, known as “SSA 1” in Horowitz’s report but believed to be FBI supervisory special agent Joseph Pientka, was the same man who accompanied fired FBI special agent Peter Strzok in their controversial interview of Flynn in January 2017.

Men charged with having $7 million worth of fentanyl released without bail under New York’s new criminal justice law






A judge allowed six men charged with possession of millions of dollars worth of fentanyl to be released without bail, a result of New York’s new criminal justice law, according to the New York Post.

Livo Valdez, Jaslin Baldera, Frederick Baldera, Frandi Ledema, Diego Tejada, and Parfraimy Antonio were arrested Monday in an alleged heroin and fentanyl packaging mill, in which police found hundreds of thousands of envelopes of fentanyl powder — valued at $7 million.

Authorities believe the massive amount of drugs was being packaged for distribution onto the streets of New York and the New England region.

The judge at Manhattan Criminal Court released the men after their arraignment Wednesday, citing the fact that they don’t have previous criminal records and that their families showed up for the court proceedings. Assistant District Attorney Michael Di Paolo argued that “none of them are eligible for bail.”

Ralph Rebuffed: Virginia Senate Blocks Another Northam Gun Control Measure



The Virginia Senate blocked one of Gov. Ralph Northam’s top gun-control bills Monday, adding to the list of measures the Democratic governor supports that may not pass the legislature.

The Senate Judiciary Committee voted against a bill that would make it a felony to “recklessly leave a loaded, unsecured firearm” in a way that endangers a minor.

It’s one of eight gun-related proposals that Northam has urged lawmakers to adopt. Virginia has become ground zero in the nation’s raging debate over gun control and mass shootings as a new Democratic majority seeks to enact strict new limits. Last month, tens of thousands of guns-rights activists from around the country flooded the Capitol and surrounding area in protest, some donning tactical gear and carrying military rifles.

Two moderate Democrats — Sens. Creigh Deeds and Chap Petersen — joined with Republicans to defeat the bill Monday over concerns that law-abiding gun owners could be unfairly punished.

A similar measure has already passed the House, and the legislation could still pass the Senate later during this year’s legislative session.

“This bill will keep children safe from loaded, unsecured firearms. Like Gov. Northam’s other commonsense gun safety measures, it is something that everyone — including responsible gun owners — should support,” said Northam’s spokeswoman, Alena Yarmosky.

The veteran radio host broke the news earlier today on his show, telling his viewers, “I can’t help but feel that I’m letting everybody down with. The upshot is that I have been diagnosed with advanced lung cancer.”

Blue check marks on Twitter couldn’t contain their delight.

“It’s not cool to joke about Rush Limbaugh having cancer. You might jinx it,” said writer Johnny McNulty.

Rush Limbaugh Announces Advanced Lung Cancer Diagnosis



On Monday, talk radio took a devastating blow as syndicated conservative Rush Limbaugh announced on air that he had been diagnosed with advanced lung cancer.

Limbaugh, a pioneer of the talk radio format, said upcoming treatments would impact his broadcasting abilities in the future.

Ladies and gentlemen, this… This day has been one of the most difficult days in recent memory for me because I’ve known this moment was coming in the program today. Now, I’m sure that you all know by now, I really don’t like talking about myself, and I don’t like making things about me other than in the usual satirical, parodic, joking way.

I like this program to be about you and the things that matter to all of us. The one thing that I know that has happened over the 31-plus years of this program is that there has been an incredible bond that has developed between all of you and me. Now, this program’s 31 years old, and in that 31 years, there are people — you hear them call all the time — who have been listening the whole time. They’ve been listening 30 years or 25 years.

I just had somebody say they’ve been here three years. But, whatever, it is a family-type relationship to me, and I’ve mentioned to you that this program and this job is what has provided me the greatest satisfaction and happiness that I’ve ever experienced, more than I ever thought that I would experience. So I have to tell you something today that I wish I didn’t have to tell you.

It’s a struggle for me because I had to inform my staff earlier today. I can’t escape… Even though people are telling me it’s not the way to look at it, I can’t help but feel that I’m letting everybody down with this. But the upshot is that I have been diagnosed with advanced lung cancer, diagnosis confirmed by two medical institutions back on January 20th. I first realized something was wrong on my birthday weekend, January 12th.

I wish I didn’t have to tell you this, and I thought about not telling anybody. I thought about trying to do this without anybody knowing, ’cause I don’t like making things about me. But there are going to be days that I’m not gonna be able to...
