50 Years of Federal Gun Control: The 1968 Gun Control Act

Today marks the 50th anniversary of the passage of the Gun Control Act of 1968. The GCA is the main federal law that governs interstate commerce of firearms in the United States. Specifically, the GCA prohibits firearms commerce across state lines except between licensed manufactures, dealers, and importers. Under the GCA, any individual or company that wants to partake in commercial activity dealing with the manufacture or importation of firearms and ammunition, or the interstate and intrastate sale of firearms must possess a Federal Firearms License (FFL).

Procedural jargon notwithstanding, the enactment of 1968 GCA was a watershed moment in U.S. politics. It was the first piece of legislation that put the gun control debate on the map.


Political Context of the GCA

It should be noted that the GCA was not the first piece of gun control passed at the federal level. In 1934, president Franklin Delano Roosevelt signed the National Firearms Act of 1934 into law. The first comprehensive gun law at the federal level, the NFA taxed and mandated registration of certain firearms such as machine guns, sawed-off rifles, and sawed-off shotguns. This law was passed under the pretext of addressing mob-style violence during Prohibition. But careful review of the New Deal era shows how the NFA was just another piece of FDR’s unprecedented social engineering program.

This NFA was followed up by the Federal Firearms Act of 1938, which created a precursor to the 1968 GCA’s FFL system. Despite the government’s encroachments on gun rights, the federal government stayed away from further regulation for the next three decades.

Once the 1960s arrived, gun politics reverted back to its interventionist roots. The assassinations of John F. Kennedy, Robert F. Kennedy, and Martin Luther King caused federal policymakers to rethink gun policy. In the JFK case, considerable uproar was made about how his assassin, Lee Harvey Oswald, was able to acquire his firearm via mail-order purchase. Even though President Lyndon Baines Johnson was not able get licensing and gun registration on the table, he succeeded in signing the GCA into law.

The Birth of Pro-Gun Lobbies

The passage of the GCA wasn’t without its fair share of opposition. Groups like the National Rifle Association, which traditionally focused on conservation and outdoor niches, were compelled to take nominally pro-gun stances. The NRA wasn’t alone, however. Groups likeGun Owners of America came into the spotlight positioning themselves as a “no compromise” alternative to NRA. By the early 1980s, pro-gun lobbies would become pivotal actors in the never-ending circus of DC politics.

The Gun Control Apparatus Continues to Grow

In pro-gun circles, it’s fashionable to brag about how the Second Amendment has stood strong against government infringements. In a relative sense, this is somewhat accurate. Compared to say, the health care sector , gun rights are in some regards more secure. But in the present-day climate of administrative politics, complacency is government growth’s best friend. And from the looks of it, there are some troubling developments gun owners cannot ignore.

The passage of the 1968 GCA not only gave the federal government an entry point into firearms commerce, but also served as a springboard for future interventions like the Brady Handgun Violence Prevention Act of 1993. The Brady Act takes advantage of the GCA’s FFL system by mandating that all licensed firearms sellers conduct background checks of potential purchasers. The Brady Act also paved the way for the creation of the infamous National Instant Background Check System. NICS is an integral feature of the federal gun control apparatus and has been in existence for two decades, despite research showing it has been ineffective in deterring crime.

These government intrusions aren’t without their fair share of disturbing consequences. According to gun researcher John Lott, the number of federally licensed firearms dealers (FFLs) has decreased from 283,000 in 1993 to 118,000 in 2013. Higher licensing costs played significant role in pricing out smaller weapons dealers. This trend will likely continue as the regulatory state grows larger by the day.

DOJ Finalizes Rule Classifying Gun Parts as Firearms Requiring Background Checks


The Biden Department of Justice (DOJ) finalized a rule Wednesday that classifies parts in a gun parts kit as firearms that require a background check to purchase, like the one required for “traditional firearms.”

Breitbart News reported the then-proposed rule on April 11, 2022, noting that the new classification of gun parts was designed to be part of an effort to ban firearms that Democrats describe as “ghost guns.”

Democrats use the phrase “ghost guns” to describe firearms Americans can build themselves. The firearms are often built from an 80 percent receiver in the case of a rifle, or 80 percent frame, in the case of a pistol. Building such guns has long been an American hobby. The rule, as proposed by the DOJ, refers to the 80 percent parts kits as “buy, build, shoot” kits and they label the kits themselves as “firearms.”

On August 24, 2022, the DOJ announced its rule is now final and in effect.

The text of the Final Rule 2021R-05F makes clear that a “partially complete frame or receiver” is now covered under the definition of “frames” or “receivers.”

  • To help keep guns from being sold to convicted felons and other prohibited purchasers, the rule makes clear that retailers must run background checks before selling kits that contain the parts necessary for someone to readily make a gun.
  • To help law enforcement trace guns used in a crime, the rule modernizes the definition of frame or receiver, clarifying which part of a weapon must be marked with a serial number – including in easy-to-build firearm kits.
To help reduce the number of unmarked and hard-to-trace “ghost guns,” the rule establishes requirements for federally licensed firearms dealers and gunsmiths to have a serial number added to 3D printed guns or other un-serialized firearms they take into inventory.

No Secret: You Can Make Your Own Glock Gun or AR-15 Assault Rifle

The Ruger 10/22 semiautomatic rifle is typically one of the first firearms a gun owner purchases. Although relatively cheap and inexpensive, the lure of do-it-yourself has created eighty percent lowers for the 10/22 as well. Unfinished 10/22 lowers are typically sold with the need for the barrel V block attaching point to be milled out, as well as a number of holes for pins and screws. Like the Glock 80 percent, 10/22 receivers often have more features and a more aggressive styling than their original manufacturer equipment equivalents.

The Bureau of Alcohol, Tobacco, Firearms & Explosives, the agency that regulates gun ownership in the United States, recognizes that individuals have a historical right to make their own firearms. While this may have been common in the eighteenth century, it is only recently becoming popular again due to the high tolerances of modern machinery and the widespread availability of powered tools. As a result Americans have the ability to make a wide variety of firearms, from pistols to semiautomatic rifles, in their own homes.

Modern home firearms production is the result of so-called “80 Percent” firearms receivers. Every firearm has a receiver, a common part that brings together the grip, stock, trigger group, barrel and action. It’s similar in function to a car chassis. In the world of small-arms parts, the necessity of a receiver makes it the only single part regulated by the BATFE, and legally designated as a firearm.

One exception to the receiver-as-firearm rule is that a receiver that is 80 percent complete or less is not subject to regulation; in other words, it is not legally a firearm. Unlike firearms, “eighty percent” receivers can be purchased in a brick and mortar store and brought home without filling out paperwork or conducting a background check, or may be purchased online and shipped straight to an individual’s home.

Once at home, an 80 percent receiver is typically secured to a workbench and set in a jig. Using common home tools, including a router, power drill and file, a handy person can complete the remaining 20 percent of the receiver in a matter of hours. N.Y. DAD’S PISTOL LICENSE SUSPENDED OVER SOMETHING HIS 10-YEAR-OLD SON SAID — AND IT COULD BE 8 YEARS BEFORE HE GETS IT BACK


A New York father has had his firearms all but confiscated after the Suffolk County Pistol License Bureau suspended his pistol license indefinitely over a perceived threat made by his 10-year-old son and two of his classmates at school.

John Mayer, of Commack, N.Y., told TheBlaze that the incident occurred on March 1. It was like any other day, the father explained. He put his son on the bus and sent him off to school.

Later that day, Mayer got a call from school officials at Pines Elementary School informing him that his 10-year-old son and two other students were talking about going to a boy’s house with a water gun, “paint gun” and a BB gun. There had reportedly been a school yard pushing incident the day before involving the boys, excluding Mayer’s son, and they were seemingly talking about getting even in some way.

Mayer told TheBlaze that a teacher overheard the students talking and informed the principal, who then immediately called police and filed a report. He said the principal told police something to the effect of, there’s a “kid with a gun, ready to go.” Mayer maintains that no serious death threats were made by the students. The Hauppauge Public School District has not returned several messages left by TheBlaze, therefore, it is not clear what they are claiming was said.


School officials then “interrogated” the boys, Mayer explained. It was later determined that the 10-year-old boys did not have access to a BB gun, paintball gun or any actual firearms.

The school’s principal later informed the father that his son would be suspended for two days for the incident. But the ordeal was far from over.

Mayer said police officers were then deployed to his home where he was advised by officers that they might have to confiscate his firearms, which he says were all properly stored and secured. “I just couldn’t believe what was happening,” he told TheBlaze.

The following Monday, Mayer got a call from the Suffolk County Pistol Licensing Bureau. He was reportedly told that his license would be suspended and police would arrive at his house the next morning to retrieve his handguns. Acting quickly on the advice of his attorney, Mayer transferred all 15 of his handguns to his friend to prevent them from being confiscated. He also transferred his long arms to a local gun store out of fear that police would attempt to confiscate them as well.

However, that hardly fixed the problem.

Mayer’s pistol license has been suspended until further notice and he says officials have informed him that the suspension could last until his son moves out of his home. His son is only 10-years-old, meaning it could be eight years or longer before his license is restored.

“All my handguns are gone,” Mayer said, letting out a sigh of exasperation.

“We’ve grown to such an absurd point now with firearms where kids can’t even be kids,” he added. He also brought up the fact that there are now students getting suspended for pointing their fingers like “firearms.”

A spokesperson with the Suffolk County Police Department told TheBlaze that the incident is still under investigation.

“The Suffolk County Police Department Pistol License Bureau is conducting a complete and thorough investigation into the matter. Based upon the investigation, his license has been suspended,” the spokesperson told TheBlaze in an email. SCPD declined to provide any additional information.

Mayer’s lawyer, New York firearms attorney James Murtha, told TheBlaze that Mayer does not have any history of mental illness or criminal behavior. He also noted that Mayer’s son does not have a history of violent behavior.

“We understand that in this day and age things can get perceived wrong,” Murtha said. “But we are talking about a child making silly comments. And now a man’s constitutional rights have been dramatically violated.”

Gun rights “mean nothing at all in New York,” Murtha lamented. “Firearms are thought to be some really evil thing here.”

In New York, he explained, a citizen can be a denied a pistol license if the pistol licensing department determines that person doesn’t have “good moral character,” an undefined term:

Eligibility requirements for the issuance of a pistol license in New York are set forth in Penal Law §400.00(1). Briefly, an applicant must (1) be twenty-one years of age; (2) of good moral character; (3) have not been convicted of a felony or serious offense; (4) state whether he has ever suffered from mental illness or been confined to an institution for mental illness; and (5) not had a pistol license revoked or who is not under a suspension or ineligibility order issued pursuant to CPL 530.14 or Fam. Ct. Act 894-a.

“A clear message has to be sent that the government can’t treat citizens this way,” he added. “Firearms are not frightening. Not a single one of my firearms has ever put on a pair of shoes, run down the street and killed somebody.”

Mayer is now pushing for New York to adopt legislation similar to Maryland’s S.B. 1058 or the “Reasonable School Discipline Act of 2013.” He says it would protect the rights of students and parents.

The legislation prohibits a principal from “suspending or expelling a student who brings to school or possesses on school property a picture of a gun, a computer image of a gun, a facsimile of a gun, or any other object that resembles a gun but serves another purpose.”

The bill also prohibits a principal from suspending or expelling a student for making a “hand shape or gesture resembling a gun.” The law does, however, reinforce a principal’s right to discipline students for performing “a direct act of violence against another student.”

Mayer first brought his story to the popular firearms website LongIslandFirearms.com, where he is a respected member, according to the site’s operator. The website is currently accepting donations to help cover Mayer’s legal fees.

Virginia Is Ground Zero in the War over Gun Control



When Democrats won control of both houses of the Virginia Legislature November 5, 2019, Virginia gun-owners got a rude wake-up call. Now that wake-up call is spreading to gun-owners throughout the rest of the 49 states.

In July 2019, Gov. Ralph Northam proposed a package of eight proposals that would tighten Virginia's gun laws, known as some of the least restrictive in the country. Currently, Virginia's gun control measures of merit ban the sale of firearms only to high-risk individuals and those convicted of domestic violence. However, the proposals would turn the least restrictive into what some would call dangerously restrictive, a premeditated strike against the Second Amendment. Northam's proposed package calls for legislation:
  • Requiring background checks on all firearms sales and transactions. The bill mandates that any person selling, renting, trading, or transferring a firearm must first obtain the results of a background check before completing the transaction.
  • Banning dangerous weapons. This will include bans on assault weapons, high-capacity magazines, bump stocks and silencers.
  • Reinstating Virginia's successful [sic] law allowing only one handgun purchase within a 30-day period.
  • Requiring that lost and stolen firearms be reported to law enforcement within 24 hours.
  • Creating an Extreme Risk Protective Order, allowing law enforcement and the courts to temporarily separate a person from firearms if the person exhibits dangerous behavior that presents an immediate threat to self or others.
  • Prohibiting all individuals subject to final protective orders from possessing firearms. The bill expands Virginia law which currently prohibits individuals subject to final protective orders of family abuse from possessing firearms.
  • Enhancing the punishment for allowing access to loaded, unsecured firearm by a child from a Class 3 Misdemeanor to a Class 6 felony. The bill also raises the age of the child from 14 to 18.
  • Enabling localities to enact any firearms ordinances that are stricter than state law. This includes regulating firearms in municipal buildings, libraries and at permitted events.

Incoming Democratic speaker of the House of Delegates Eileen Filler Corn said gun control is a top Democratic priority for 2020 as she was recently interviewed for Fox News's On the Hill. This puts the Democrat majority squarely in the middle of a groundswell of activism. As Virginia becomes ground zero for virulent gun control activists, such as Moms Demand Action, they are met by the equally fierce Virginia Citizens Defense League (VCDL), who are determined to protect Second Amendment rights. While Virginia is home to the National Rifle Association (NRA), the VCDL grassroots organization, founded in 1994, is taking the lead in the fight against the legislation. This fight, while still predominantly Virginia-focused, is turning into growing national movement via social media, as word is spreading to gun-owners across the country. The concern is that what happens in Virginia could soon be coming to a state near you, or your own state, via legislative initiatives.

The gun control topic has become so impassioned that VCDL is mounting a 50,000-plus lobbying effort slated for January 20 in the Richmond capital, the day the Democrats assume power. Major red flags surround Citi Group’s egregious gun control move

Citi Group just positioned itself for major backlash as it is the latest in the growing list of companies caving in to demands by anti-Second Amendment advocates.

In a statement condemning gun violence and the lack of gun control policies, the bank announced Thursday that it would start requiring clients to place some restrictions on gun sales. Fox News’ Tucker Carlson noted the alarming new trend as the “left is now colluding with large companies to roll back your rights to bear arms without any legislation at all.”

Although the company stated that the new policy is “not centered on an ideological mission to rid the world of firearms,” the announcement concluded with Citi showing non-conformers the door.

“We know our clients also care about these issues and we have begun to engage with them in the hope that they will adopt these best practices over the coming months,” the statement read. “If they opt not to, we will respect their decision and work with them to transition their business away from Citi.”

Free Beacon writer Stephen Gutowski summed up the bank’s decision.

The bank will cease doing business with anyone that sells any firearms to anyone under 21 years old and any business that sells "high capacity magazines." It does not specify what constitutes a "high capacity magazine" in their estimation.
Perhaps, Gutowski’s most disturbing observation comes for a passage that insinuates Citi Bank might be trying to put pressure on other financial institutions to do the same.

This passage is particularly ominous. Sure sounds like they want to pressure other financial institutions into instituting similar policies to deny consumers the right to purchase the legal protects Citi Bank doesn't like.
